In the event you and IR have executed a mutually agreed upon and separately executed and signed privacy agreement specifying the collection, use, and sharing of your data, and should any provision of this Policy contradict or be in conflict with any provision of such agreement or any annexure thereto and such contradiction or conflict not being reconcilable, then the provisions of that agreement shall take precedence and the contradicting or conflicting provision shall be deemed invalid.

Our privacy practices cover all our technologies and business processes and are based on the following principles:

  1. Management Responsibility - The management responsibility principle assigns IR executive management with responsibility for defining, documenting, promoting, and communicating the IR Privacy Policies and programs.
  2. Notices - IR provides reasonable notice when Personal Data is collected and also discloses the purpose for which individual data is collected, stored, and processed.
  3. Choice - Individuals are informed of their available choices in providing Personal Data ("opt-in" or "opt-out").

1. User Consent

1.1. By submitting or making available Application Data or Personal Data through our website, products, or related services, you agree to the terms of this Privacy Policy and you consent to the processing of your Application Data and Personal Data in accordance with this Privacy Policy.

2. Data We Collect

2.1. IR collects Personal Data, Anonymous Data, and Application Data from you when you visit our site, when you send us information or communications, and when you download and use our Products.

2.2. Personal Data

  1. We collect Personal Data from you. “Personal Data” is any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

For example, we read an email address as an identifier e.g., but we do not allow the addition of a natural language name unless that explicitly exists in the customer system e.g. John Doe and our system has been configured by you to read that name.

We also use certain usage data to support regulatory requirements, such as calculation and reporting of tax or similar obligations.

2.3. Personal Data Collected by Third Parties

  1. We may receive Personal Data about you from other sources such as telephone or fax, from companies that provide our products or services by way of a co-branded or private-labelled website, companies that offer their products and/or services on our website, or companies that provide services (such as payment processing services) in connection with our website (“Partner Companies”). Our Partner Companies may supply us with Personal Data, such as your name and e-mail and mailing address information, in order to help us establish the account or fulfil orders.

2.4. Anonymous Data

  1. To make our website, products, and related services more useful to you, our servers (which may be hosted by a third-party service provider) collect Anonymous Data from you, such as browser type, operating system, Internet Protocol (IP) address, domain name, and/or a date/time stamp for your visit (“Anonymous Data”). Anonymous Data has all Personal Data references removed such that the data cannot be reverse engineered or in any way attributed to the individual from which the information was collected. Anonymous Data collected by IR includes information about the date and time of the anonymous user’s visit and about how they have used the product.

Like most Internet services, we automatically gather data about you or your device browser including your IP address, cookies and the pages you request and store it in log files each time you visit our website or access your account on our network. This data allows you a better experience using our products.

2.5. Application Data

  1. IR collects Application Data when our products are deployed in your IT environment. “Application Data” means data about the performance of your application, system data (such as version data, names of plug-ins, etc.) about the environment in which your application is operating, data about transactions being monitored by our Services, stack traces and source code snippets for certain classes of errors, and other similar data related to your application. Only data that is relevant to the Service you have purchased from IR will be collected.
  2. Some services may collect messages being sent and received from your Contact Centre so that we can convey those messages to and from carrier networks. Similarly, to transmit voice calls to and from the telecommunications carrier networks, we collect the voice communications being sent and received to route them appropriately. You can also use our products and services to record voice communications or have them transcribed, in which case, we will also collect those voice recordings or transcriptions.

2.6. Information from Children

  1. We neither direct or target our products and services at nor do we intentionally collect Personal Data from children who are under the age of 13. Further, we request that these individuals do not provide Personal Data through our Services.

2.7. Personal Health Information and Sensitive Information

  1. IR’s Services are not intended for, and you shall not use IR’s products or services to receive, send or otherwise process Personal Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act of 1996 as amended (HIPAA), or any sensitive personal information (e.g. information related to racial or ethnic origin, political opinions, religion, or criminal background) unless otherwise provided in your written agreements with IR.

2.8. Cookies

  1. “Cookies” are small pieces of information, which typically includes an anonymous unique identifier, that are sent to your browser and stored on your hard drive or in device memory when you view a webpage, an advertisement, a video or other types of content. We link the information we store in Cookies to the personally identifiable information you submit while on our site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our website. Your Web browser may allow you to delete, block or otherwise disable the use of Cookies or HTML5. 2.9. How We Respond to Do Not Track Signals

  1. Please note that your browser setting may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit to disable its tracking of an individual user. There is no industry consensus as to what “Do Not Track” means in this context. Similarly, to many websites and online services, IR does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser.

Disclosure of Your Data

3.1. Regardless of any choices you make regarding your Personal Data (as described below), IR may disclose Personal Data or Application Data if it believes in good faith that such disclosure is necessary to:

  1. investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of IR’s terms of use, or as otherwise required to comply with relevant laws, regulation, legal process or a government request (including to meet national security or law enforcement requirements) or to respond to subpoenas or warrants served on IR; or
  2. respond to an emergency which we believe in good faith requires us to disclose data to assist in preventing a death or serious bodily injury; or

4. Data Transmission and Storage

4.1. IR is committed to protecting the security of your Application Data, Anonymous Data, and Personal Data of any format or media. We use appropriate security measures to protect the security of your data both online and offline. All Personal Data is encrypted in transit and at rest, all Anonymous and Application Data is encrypted in transit. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people.

4.2. Since no data transmitted over the internet can be 100% secure, we cannot guarantee the security of any information you transmit to us. However, we make every effort to secure your data by working closely with trusted third-party vendors and hosting partners needed to run the IR Services. Such hosting partners utilize world class security measures including physical premises, network, and identify access management security practices. 5. Your Choices Regarding Your Personal Data

5.1. We offer you choices regarding the collection, use, and sharing of your Personal Data. You will automatically be subscribed to receive optional email messages. We will periodically send you free newsletters and e-mails that directly promote the use of our site or the purchase of our products or services. 6. Advertising & Retargeting

6.1. We may partner with a third-party ad network to either display advertising on our Web site or to manage our advertising on other sites. Our ad network partner may use cookies and Web beacons to automatically collect non-personally identifiable information about your activities on this and other Web sites. This information may include the content you view, the date and time that you view this content, the products you purchase, or your location information associated with your IP address.
